Flink Maswick Law Successfully Defends Against Professional Misconduct Allegations

Flink Maswick Law was recently retained to assist a medical doctor in defending against allegations of professional misconduct by the Office of Professional Medical Conduct (OPMC). These proceedings, commenced by the OPMC, typically involve OPMC reviewing information related to claims of misconduct, interviewing the medical professional accused of misconduct, and a further board review of notes taken during the interview.
In a recent matter handled by the Flink Maswick Law team, our office performed research into the matter and allegations against our client, drafted a letter to the OPMC outlining our argument as to why our client should not be found to have committed professional misconduct, and the allegations were dismissed prior to our client needing to appear for an interview. At the close of proceedings, all allegations have been dropped and our client was cleared of any wrongdoing.
Proceedings of this nature occur on a regular basis in New York State and may involve allegations with no basis in fact or allegations involving events completely unrelated to the professional field. In these situations, it is best to be proactive and maintain open lines of communication between the attorney involved in the matter and the professional board investigating the allegations. Our team addressed the claims made against our client head on, making a strong case demonstrating why our client had not committed misconduct and obtained a great outcome in the process, without the need for an interview.
