November 24th, 2022 marked the opening of the one year “look back period” for victims of sexual assault and sexual abuse to bring claims against their abusers under the Adult Survivors Act. The Act (see Governor Kathy Hochul Signs Adult Survivors Act into Law (flinkmaswicklaw.com) allows victims of sexual abuse that occurred after the age of 18, to bring civil claims against their perpetrators in situations where their claims had previously been time barred by the statute of limitations.
The “look back period” will run from November 24, 2022 to November 24, 2023 and will allow victims to assert claims against not only against their former abusers, but also against institutions or employers that would have been liable had the claims been timely asserted. The act also grants trial preference for these matters so that they can be adjudicated in a timely manner.
Sponsored by Senate Judiciary Committee Chair Senator Brad Hoylman, the Adult Survivors Act was signed into law by Governor Kathy Hochul earlier this year.
